Provincial Laws on Mining In Argentina

Provincial laws operate within norms of the National legislative framework by providing the operational legal regulation such as approval procedures. In this context Provincial laws interact with national laws which, for example, provide norms for content of EIAs and on responsibility for environmental damages.

How do the Province obtain power to assess Environmental Impact Statements?

The determined authority applying mining EIA legislation is the province where the project is located National Law 24.196 (Spanish).

Provincial Environmental Legal Framework

The power invested in Provinces to regulate environmental provisions results in different regulatory framework within each Province, however under the national framework, each province bears the responsibility for access to information, public display of environmental documents and responsibility for project approval.
